34.3. If a person ceases to be a member of this plan before becoming eligible for a pension or deferred annuity, he may, if he has at least two years of service, apply for a deferred annuity or, subject to sections 34.12 and 34.13, the refund of his contributions. However, he may not obtain such a refund if section 21 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10), referred to in section 9 of this Act, applies, or if he again becomes a member of the plan, or after he has reached 65 years of age.
Where the person dies before obtaining the refund of his contributions and before his deferred annuity becomes payable, his contributions shall be refunded to his spouse or, where he has no spouse, to his successors.
